Service Description

RunBackhouse is a cloud-based software service for the hospitality industry, operated by RUNBACKHOUSE, LLC. It provides restaurant and venue operators with tools for staff scheduling, tip management, inventory tracking, daily sales reporting, communication, and operational workflow management.

The Service is provided by subscription and is accessible through web browsers and mobile devices. Features vary by subscription plan and venue configuration.

We may modify, suspend, or discontinue part of the Service with reasonable notice. We will make commercially reasonable efforts to notify active subscribers of material changes at least 30 days in advance.

Account Terms

You must provide accurate and complete information when creating an account. You are responsible for keeping account credentials confidential and for activity that occurs under your account.

Account administrators are responsible for adding users, removing users, and assigning roles within their venue. Each user must have a unique account. Sharing login credentials is prohibited.

You must be at least 18 years old to create a manager account. Staff accounts may be created for individuals age 16 and older in accordance with applicable labor laws.

Notify us immediately if you discover unauthorized access to or use of your account.

Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Store, transmit, or distribute unlawful, harmful, threatening, abusive, or otherwise objectionable content.
• Attempt to gain unauthorized access to accounts, infrastructure, systems, or networks connected to the Service.
• Reverse engineer, decompile, disassemble, or attempt to derive source code from the Service.
• Use the Service in a way that could damage, disable, overburden, impair, or interfere with the Service or another party's use of it.
• Resell, sublicense, or commercialize the Service without written consent from RUNBACKHOUSE, LLC.

Data Privacy

Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms.

You retain ownership of data you enter into the Service. We access, use, or share Customer Data only as needed to provide the Service, comply with law, or as described in the Privacy Policy.

We use security measures including encryption in transit and at rest, access controls, and security reviews. No electronic system is completely secure, and we cannot guarantee absolute security.

After termination, you may request an export of Customer Data within 30 days. After that period, we may delete data in accordance with our retention policies.

Limitation of Liability

To the maximum extent permitted by law, RUNBACKHOUSE, LLC. and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or lost business opportunities, arising from use of the Service.

Our total aggregate liability for claims arising under these Terms will not exceed the amount paid for the Service during the 12 months before the event that gave rise to the claim.

The Service is provided on an "as is" and "as available" basis. We make no express or implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Termination

You may terminate your account through account settings or by emailing support@runbackhouse.com. Termination takes effect at the end of the current billing period unless otherwise agreed.

We may suspend or terminate access immediately if you breach these Terms, fail to pay fees, or if we reasonably believe your use poses a security risk.

Terms that should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
